General Terms and Conditions

§1 Validity of the conditions

The deliveries, services and offers of ALPLINEPAWS GMBH are made exclusively on the basis of these terms and conditions, even if they are not expressly agreed again. By ordering the goods or services, these conditions are deemed accepted. The purchaser’s general terms and conditions of purchase are hereby rejected. Deviations from these terms and conditions are only effective if we confirm them in writing.

§2 Offer and conclusion of contract

The offers of ALPLINEPAWS GMBH in price lists and advertisements are subject to change and non-binding. Orders are only binding for ALPLINEPAWS GMBH after written confirmation. Order confirmations are only issued upon express request. The offer of products is directed exclusively at customers with a residence or registered office in Switzerland. Deliveries are made exclusively to addresses in Switzerland. The details in our sales documents (drawings, illustrations, dimensions, weights and other services) are to be understood only as approximate values and do not represent any assurance of characteristics, unless they are expressly designated in writing as binding. If a purchaser exceeds his credit limit by placing an order, we are released from our obligation to deliver.

§3 Prices

The prices stated in our order confirmation are decisive. These are fixed for stock goods at the time of the order. In the case of supply bottlenecks and procurements, the daily price on the day of the order applies. The prices are, unless otherwise agreed, plus transport costs and include the statutory value added tax.

Price guarantee comparison: retail and online shops throughout Switzerland. Valid 14 days from purchase, excluding promotional offers.

§4 Delivery and performance time

Dates and delivery periods are non-binding, unless something different has been expressly agreed in writing. The indication of specific delivery periods and delivery dates by ALPLINEPWAS GMBH is subject to correct and timely delivery to ALPLINEPWAS GMBH by suppliers and manufacturers.

§5 Default of acceptance

If the purchaser refuses to accept the delivery items after expiry of a grace period set for him, or declares that he does not wish to accept the goods, ALPLINEPAWS GMBH may refuse performance of the contract and claim damages for non-performance. ALPLINEPAWS GMBH is entitled to demand from the purchaser, at its discretion, either a lump sum of 25% of the agreed purchase price or compensation for the actual damage incurred as damages.

§6 Delivery / collection in branch

Visible quantity differences must be reported in writing immediately upon receipt of the goods, hidden quantity differences within 4 days after receipt of the goods, to ALPLINEPAWS GMBH and the carrier. Complaints regarding damage, delay, loss or poor packaging must be reported immediately upon receipt of the consignment of goods.

If the customer does not collect the ordered products from a branch (pickup collection) within 14 calendar days from the agreed date in the branch, ALPLINEPAWS GMBH may dissolve (cancel) the contract and charge the customer a processing fee of 20% of the order value, but at least CHF 60.–, as well as any loss in value of the ordered products.

§7 Transfer of risk

The risk passes to the purchaser as soon as the consignment has been handed over to the person carrying out the transport. If dispatch is delayed or becomes impossible without our fault, the risk passes to the purchaser upon notification of readiness for dispatch. An agreement in an individual case that ALPLINEPAWS GMBH will bear the transport costs has no influence on the transfer of risk.

§8 Warranty

The warranty in accordance with the following provisions is 2 years, unless something different has been expressly agreed in writing. The warranty period begins on the date of delivery. If our operating or maintenance instructions are not followed, changes are made, parts are replaced, or consumables are used that do not correspond to the original specifications, any warranty shall lapse insofar as the defect is attributable thereto. This also applies insofar as the defect is due to improper use, storage and handling of the devices, or intervention by third parties as well as the opening of devices. Insignificant deviations from the guaranteed characteristics of the goods do not give rise to warranty rights. Liability for normal wear and tear, as well as for consumables/accessories, is excluded. Warranty claims against ALPLINEPAWS GMBH are available only to the immediate purchaser and are not assignable.

Veterinary medical diet food should only be used on recommendation and under regular supervision by the pet’s veterinarian. The veterinarian should be consulted regularly (every 6 months) during feeding for check-up examinations and immediately in the event of a deterioration in the pet’s health. ALPLINEPAWS assumes no liability for the consequences of improper or medically not indicated use of veterinary medical diet food.

§9 Returns

You can return the goods received in the original packaging with all accessories within 14 days. This does not apply to used or cut-to-size items (nets, hoses). Damaged products will not be taken back or will be fully charged to the customer. In the case of a return, the return slip must be enclosed, duly completed.

You will receive a receipt from the post office when you post the parcel. Please keep this in a safe place, because in the event of a parcel being lost, your return can only be credited upon presentation of this receipt.

If the customer makes use of their right of return, ALPLINEPAWS will refund the full purchase price minus any minimum quantity surcharge paid and/or postage.

Returns due to a defect require prior consent from ALPLINEPAWS GMBH. For this purpose, send a complete and detailed description of the error/defect and a copy of the invoice with which the device was delivered to our customer service. The return shipment is at the customer’s expense. The replacement of parts, assemblies or entire devices does not result in new warranty periods coming into effect. The warranty is limited exclusively to the repair or replacement of the damaged delivery items.90

§10 Retention of title

The delivered goods remain the property of ALPLINEPAWS GMBH until full payment has been made.

§11 Payment

Payment options

All payment claims for products and services purchased via the online shops of ALPLINEPAWS GMBH are asserted by ALPLINEPAWS GMBH directly with the customer.

Payments must be made in Swiss francs.

The customer has at their disposal the payment options offered as means of payment in the online shop under “Means of payment”.

In the case of payment by credit card or other immediate means of payment, the charge is made upon ordering.

In the case of purchase on account, the customer is obliged to pay the invoice amount within 30 calendar days after receipt of the delivery without any (cash discount) deduction. In the case of a partial return of the delivered products, the invoice amount can be reduced accordingly. Vouchers of any kind are excluded from payment on account.

Delivery is generally carriage forward, i.e. at the buyer’s expense by parcel post, forwarding agent or own vehicle, unless expressly agreed otherwise. A payment is only deemed to have been made when we are able to dispose of the amount.

Default of payment

If the customer fails to meet their payment obligations in whole or in part, all outstanding amounts owed to ALPLINEPAWS GMBH will be due. ALPLINEPAWS GMBH may suspend further deliveries of products to the customer at any time.

ALPLINEPAWS GMBH charges a processing fee of CHF 10.– for the 1st reminder (after expiry of the 30-day payment period) and a processing fee of CHF 20.– for the 2nd reminder (after expiry of the 45-day payment period. In the event of unsuccessful reminders, the invoice amounts may be assigned to a company commissioned with collection. The company commissioned with collection will assert the outstanding amounts in its own name and for its own account and may charge additional processing fees.

§12 Limitation of liability

Claims for damages arising from impossibility of performance, from breach of contract, from culpa in contrahendo and from tort are excluded both against us and against our vicarious agents or assistants, insofar as there is no intentional or grossly negligent conduct. Any liability for consequential damages resulting from the use of the products is excluded.

§13 Copyright and intellectual property rights

Books and digital content are protected by copyright and are intended exclusively for purchase for personal use. When purchasing digital content, you acquire a simple and non-transferable right of use that entitles you, as a single user, to private or professional use. In accordance with the respective product descriptions, you may create copies of the digital content for private or other own use, store them on reading devices and use them as intended on these devices. Any further use, in particular the transfer, editing, duplication or reproduction, distribution, publication or making available to the public of the digital content, in whole or in part, whether in digital form, by data transmission or in analogue form, is not permitted and may be punishable by law.

§14 Loyalty points programme

14.1 General

With the ALPLINEPAWS GMBH loyalty card, points can be collected with every purchase on www.alplinepaws.ch as part of the loyalty points programme. All customers of ALPLINEPAWS GMBH are eligible to participate. The points account and credit balance are non-transferable and cannot be converted into cash and paid out in advance. The current status of your points account is listed in your personal customer account on www.alplinepaws.ch under “My account”.

14.2 Acquisition of loyalty points

The acquisition of ALPLINEPAWS GMBH loyalty points takes place automatically for every order placed with a registered customer account from 01.04.2025. The points are calculated on a daily basis at the time of completion of the order. As soon as the invoice amount has been posted to our account, the loyalty points are credited to the customer account. For every CHF 1.– purchase value you receive 1 loyalty point. For certain special promotions, additional points may be credited to the extent announced. In the event of a return, the loyalty points granted at the time of settlement are subtracted again when the returned items are credited. Loyalty points are not credited for redeemed vouchers or other discounts as well as subsequent deliveries.

14.3 Credit procedure

Loyalty points are automatically credited to the points account when payment for the order is posted to ALPLINEPAWS GMBH. The credit is made under the customer number used for the order. If a customer orders via several customer accounts at ALPLINEPAWS GMBH, the points are credited in accordance with the individual accounts. It is not possible to transfer points to another customer account.

14.4 Issuing of the bonus voucher

From an account balance of 1,000 points, the customer receives a bonus voucher to the value of CHF 40.–. When the 1,000 points are reached by a purchase on www.alplinepaws.ch, the voucher is sent by email to the customer email address on file. If an item from the order with which the 1,000 points were reached is returned after the CHF 40.– bonus voucher has been issued, the points account will fall into the negative by the value of the goods. If the 1,000 loyalty points are reached in a branch, the bonus voucher will be handed over directly as a voucher.

14.5 Termination of the loyalty points programme

ALPLINEPAWS GMBH reserves the right to terminate the ALPLINEPAWS GMBH loyalty points programme at any time or to replace it with another programme.

14.6 Changes to the loyalty points programme

ALPLINEPAWS GMBH reserves the right to make changes or additions to the conditions of participation, the rewards or other procedures described in the conditions of participation for the loyalty points programme at any time. Claims for damages by participants against ALPLINEPAWS GMBH are excluded. Changes or additions to these conditions of participation will be announced by publication on the website.

§15 Data protection

ALPLINEPAWS GMBH is entitled to process the data relating to the business relationship or in connection with it received about the purchaser, whether these originate from the purchaser himself or from third parties, within the meaning of the revised Federal Act on Data Protection (revDSG). Customer data are treated confidentially and only passed on to third parties within the framework of the credit check.

§16 Place of jurisdiction

Zurich is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is subject to Swiss law.

All points concerning ALPLINEPAWS GMBH also apply without restriction to dealings with ALPLINEPAWS GMBH.
